1. About SafeSeat
SafeSeat is an independent, student-run peer-to-peer marketplace that lets verified Indiana University students buy and sell their own student-section tickets directly with each other. SafeSeat is not affiliated with, endorsed by, sponsored by, or in any way officially connected to Indiana University or its athletic programs.
2. Eligibility
To create an account and use SafeSeat, you must be a currently enrolled Indiana University student with a valid iu.edu email address. By joining, you confirm that you are a current student. If you graduate, withdraw, or otherwise lose your iu.edu email access, you may no longer use the platform.
You must be at least 18 years old, or have permission from a parent or guardian if your jurisdiction requires it, to enter into these Terms.
3. Listings and Pricing
Sellers may only list tickets they personally own and have the right to transfer. Sellers set their own prices and are responsible for the accuracy of their listings, including the event, date, section, and seat information.
By listing a ticket, you represent that the ticket is valid, not voided or revoked by Indiana University or any third party, and that you have not simultaneously listed the same ticket elsewhere.
4. Fees
Buyers pay a flat $3 service fee per transaction, in addition to the seller's asking price. This fee covers payment processing and platform costs.
Sellers pay no listing or selling fees. The full asking price is remitted to the seller upon successful delivery.
5. Payment Hold and Release
When a buyer completes a purchase, funds (exclusive of the service fee) are held by SafeSeat and not released to the seller until one of the following occurs:
- The buyer confirms receipt of the ticket in their Indiana University ticketing app account; or
- The delivery window expires without a buyer dispute, at which point funds are automatically released to the seller.
SafeSeat reserves the right to withhold or reverse funds if prohibited conduct is suspected or a valid dispute is opened.
6. Refund Policy
Buyers are entitled to a full refund of the purchase price and the service fee if the seller fails to transfer the ticket within the delivery window. Refunds are processed automatically and returned to the original payment method.
If you purchase a ticket but do not accept the transfer in the Indiana University ticketing app within 24 hours of the seller initiating it, the ticket returns to the seller and the transaction is voided. Funds are returned to the buyer.
All sales are otherwise final. SafeSeat does not offer refunds because you changed your mind, were unable to attend the event, or the event was rescheduled or cancelled by Indiana University.
7. Limitations of Liability
SafeSeat connects buyers and sellers but is not the issuer of any ticket. SafeSeat cannot guarantee the validity of a ticket that Indiana University subsequently voids, revokes, or cancels for any reason, including but not limited to a violation of Indiana University's student ticket policies.
If a ticket is voided by Indiana University after a completed transaction, SafeSeat's maximum liability to any party is limited to the amount paid by the buyer in that transaction. SafeSeat is not liable for any indirect, incidental, consequential, or punitive damages.
SafeSeat is provided “as is” and makes no warranties, express or implied, regarding the platform's availability or the suitability of any listing.
8. Prohibited Conduct
The following conduct is strictly prohibited and will result in immediate, permanent removal from SafeSeat:
- Listing tickets you do not own or do not have authority to transfer;
- Creating fake, duplicate, or fraudulent listings;
- Filing fraudulent disputes or chargebacks after receiving a ticket;
- Sharing or selling access to your account to non-eligible persons;
- Attempting to circumvent SafeSeat's verification, payment, or escrow systems;
- Any conduct that violates applicable law.
9. Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Monroe County, Indiana.
10. Changes to These Terms
SafeSeat may update these Terms from time to time. When we do, we will update the date at the top of this page and, for material changes, notify users by email. Your continued use of SafeSeat after a change constitutes acceptance of the updated Terms.
